One of the most important things a personal injury lawyer or medical malpractice lawyer can do is find the right expert. In this month's Trial Lawyer magazine (published by the Oregon Trial Lawyers Association), Chuck Paulson recounts an example of how even the tiniest error by an expert can make a difference.
Chuck was asked to join in a case that was nearly prepared for trial; the other attorney had all the experts lined up and in preparation for the medical malpractice trial, the expert was asked, "If the condition had been diagnoses two months earlier would the permanent injury have been avoided?" The expert anNWered, "Absolutely". However, when the same question came up in trial, the expert responded differently. "Well, my crystal ball is a little hazy on that point." The attorney lost the case.
When preparing a medical malpractice lawsuit, it is important to find the right experts. An expert who is prepared for trial, knows the case, and understands what's at stake can make all the difference. That's why an experienced medical malpractice attorney can make the difference.
