On July 26, 2006, our firm successfully concluded a case which involved both a medication error and medical malpractice. The settlement amount was confidential. The patient -- Jane Doe had a stroke in September of 2001 and was placed on a blood thinner medication known as Coumadin to prevent further strokes. She was a smoker and also had a history of atrial fibrillation, which resulted in an increased risk of blood clots to the brain.
During her treatment for this nondisabling stroke it was discovered that she had an abnormal clotting factor in her blood which also increased her riskof a stroke or cerebral vascular accident.
She did well until Febuary 15th 2005 when her doctor took her off of the Coumadin -- a medication error. Her daughter thought that her mother had misunderstood the doctor and personally confirmed with the doctor's office and was again advised that her mom was to stop the Coumadin.
On April 29, 2005 Jane Doe sustained a massive stroke to the brain stem. She survived but cannot walk, talk, feed herself or even swallow. She is bedridden and requires 24 hour care. The case was settled for a confidential amount with a combination of lifetime monthly payments and cash.
Medication errors cause a large number of injuries to patients each year and many are preventable.
