This summer, Jane Paulson won a $600,000 lingual nerve injury verdict. Our client's lingual nerve was injured during a routine wisdom tooth extraction. In July, the defense filed a motion with the court for a new trial. The motion was heard and rejected yesterday by the judge. The defense says it will appeal the lingual nerve injury verdict.
The lingual nerve is on the tongue side of your teeth and can be permanently damaged if a dentist errs, most often by hitting the nerve with the drill, in removing a patient's wisdom teeth. Our firm believes that most permanent lingual nerve injuries from wisdom tooth extraction occur from negligence and are not an "unavoidable" risk of the procedure (as many dentists tell patients). Our firm has successfully tried four wisdom tooth extraction/lingual nerve injury cases to verdict in Oregon.
