Anyone who has been seriously injured as a result of a health care provider's negligence in providing proper treatment for a medical condition may have a claim against the health care provider for medical malpractice or medical negligence. Common examples of medical malpractice include misdiagnosis of a serious health condition, failure to order proper diagnostic testing, nerve damage from negligent anesthesiology, or failure of hospital staff to interpret a physician's medical notes resulting in improper treatment. Medical malpractice cases often require extensive discovery and investigation and this can be very expensive. It is also often difficult to prevail in medical malpractice cases. For these reasons, it is very important that you have the right medical malpractice lawyer handling your case. While many attorneys handle every day personal injury cases you will want to find an attorney specializing in medical malpractice or medical negligence. If you have sustained serious injury or death resulting in pain and suffering as well as future economic loss you deserve a medical malpractice lawyer who has the experience to be successful in litigating your medical malpractice case. One important consideration in choosing your medical malpractice lawyer is experience. The following are some questions to consider when evaluating a potential attorney's experience. How many medical malpractice or medical negligence cases has he or she handled? Did the plaintiff prevail in these cases? Did the majority of the lawyer's cases settle or proceed to trial? How much actual trial experience does the medical malpractice lawyer have? Is he or she familiar with the courts in your particular jurisdiction? You will also want a medical malpractice lawyer who will keep you up to date on the status of your medical malpractice case and who will be honest with you about your chances for success and recovery. In the same respect, you must be prepared to provide all of the necessary information and to be honest in all communication with your medical malpractice lawyer. It is difficult to get an idea of how well a potential lawyer will communicate with you. The best way is to evaluate your potential medical malpractice lawyer is during your initial consultation. Take your time to carefully consider the qualifications of the medical malpractice lawyer that you choose to represent you and your love ones.

As gas prices skyrocket, many people are doing something healthy for the planet and for their hearts: they are getting back on their bicycles. However, since many people have not ridden since childhood, it is important to remember that bicycle accidents can happen to even the strongest of riders, and that safety comes with prevention. There are several ways to avoid serious bike accidents, which people in dense cities are particularly at high risk of. One of the most obvious ways to protect oneself is to wear a helmet. Okay, so you didn’t like wearing one as a kid and now it’s even worse that you have to walk into work with a flattened head of hair. However, the head trauma that can occur as the result of a bicycle accident is reason enough to proudly sport even the ugliest of helmets. Another way to avoid collisions with other bikers, pedestrians and cars is to get a headlight and reflectors. You may be able to see a car coming at you in the darkness, but as a biker you are much smaller, and harder to see. On that note, it is also important not to ride in the blind spot of a car, particularly when stopped at an intersection where you intend to go straight, and the car beside you wants to turn right. Finally, do not ride on sidewalks. It makes you invisible to motorists, and you can hurt a pedestrian as well. Our planet could use a rest from exhaust fumes from cars, and bicycling is a healthy way for America to lose some weight, get more energy and learn to appreciate the environment again. In order to make the return to bicycles more effective and safe, avoid bicycle accidents by being aware and cautious while riding.

Insurance companies, like all other commercial enterprises, are in business for financial gain. They have the best interest of their company in mind - not the best interest of injured parties filing claims against them. Insurance companies are working for their clients, and although they say their claims are just and fair, they quite often are not. Those who have been injured due to the negligence of others should never accept the first offer from the opposing insurance company. Insurance companies are well known for quickly trying to settle claims for personal injury, but the amount of money offered isn't usually enough to cover current medical expenses let alone future medical expenses and compensation for lost wages, pain, and suffering. A personal injury lawyer should be consulted before accepting a settlement. Insurance companies use documents containing language and terms that are confusing and often hard to understand, but a personal injury lawyer can help the injured make sense of complex terms and advise them accordingly. A personal injury lawyer can help injured parties understand the complexities of insurance documents and advise them in making the right decisions regarding just compensation. A personal injury lawyer can help clients collect the compensation they deserve for cases involving but not limited to: auto, motorcycle, public transportation, medical or dental negligence and malpractice, slip & fall, wrongful death, and uninsured accidents. If you have been wrongfully injured, don't wait. Consult a personal injury lawyer immediately. A personal injury lawyer will work hard to help you gain fair compensation so you can begin to get your life as well as your health back in order.

Millions of people get hurt while going about their everyday lives: children are bitten by neighborhood pets, customers fall on wet floors with no sign out, and car accidents are all over the evening news each night. When someone is injured through no fault of their own, it is termed a “personal injury.” In order to receive compensation for these injuries, the party must contact a personal injury lawyer who specializes in fighting for the rights of individuals who have been unfairly put out of work, their personal lives, and well-being. Personal injury lawyers do not only handle cases of physical injury. They also take care of cases where the party involved has suffered emotional or mental injury as the result of either negligence or harmful intent by another party. These types of cases include, but are not limited to: emotional and mental suffering as a result of abuse, harassment and coercion. Many times, the cases that personal injury lawyers handle encompass more than one type of injury. For example, in a case of rape, the injured party has been physically, emotionally and mentally disturbed, and this event may have incurred hospital and therapist bills, as well as a deficit of money from any time that the injured party needed to take leave from work. There are personal injury lawyer listings online, and they are easily searchable through engines such as Google and Yahoo!. However, keep in mind the type of injury that has been incurred, as different lawyers specialize in varying areas of personal injury. One site that can help to narrow the search for a personal injury lawyer is the APIL (Association of Personal Injury Lawyers) website, which has a useful FAQ section, as well as an area to locate a lawyer in your area.

Imagine going into the hospital to learn that your left leg must be amputated. There is an enormous amount of emotional trauma associated with the loss of a limb to begin with, but upon waking you find that your right leg has been accidentally removed instead, and the left one must also be removed, leaving you legless. As unbelievable as this circumstance may sound, medical negligence cases like these are being fought throughout the world each day. From the time we are children, we are taught to put our lives in the hands of medical care professionals. We expect doctors, nurses, pharmacists and other people in the medical industry to perform with care and precision, and to be ethically responsible and in the right mindset to do their jobs with the utmost accuracy. However, medical professionals are people as well, and there are many extraneous circumstances that may affect performance, particularly with the demands made by hospitals and clinics today. Medical negligence may result from sleep deprivation, lack of training in a specific area, or even out of feelings of malice or malcontent. In any case of medical negligence, the bottom line is that a patient has given over his or her well-being and that they have been wronged. Medical negligence, or malpractice, is a branch of personal injury, and a patient can seek justice through the law. There is a long list of the types of malpractice that are included in medical negligence suits, including misdiagnosis, plastic surgery malpractice, prescription errors, misread x-rays, and treatment delays. In the case that a patient feels they have been the victim of medical negligence, it is advisable that they seek legal advice as soon as possible following the incident.

Often, nursing homes put on a cheery façade of goodwill and enduring patience. However, with over 1.5 million people in America in nursing homes, there are many homes that are not providing adequate care for patients. Like other care giving fields, employees of nursing homes are often overworked and underpaid, and this results in negligence of the patients, who rely on these care workers for their every need. There is no excuse for the abuse and neglect of patients in nursing homes, so it is imperative that a person searching for a home for a loved one checks out the home carefully before admitting the patient. Nursing home negligence includes the failure of the nursing staff to pay attention to the patient’s hygienic and psychological needs. Each day, thousands of patients are not given proper amounts of food, clothing or shelter. Many of these patients are overmedicated so that they will not create a disturbance that the staff will have to deal with, and as a result of their apathy they have pressure sores and a lack of social stimulation. Negligence in nursing homes also includes the staff not protecting the patients from potential health and safety hazards. In searching for a good nursing home, think about the comfort level of your loved one. It is a good idea to speak to a resident of the nursing home, instead of being spoon-fed information by the staff. See if visits can be scheduled during mealtimes, so that you can get an idea of what kind of food is being served and how the patients are treated while they are eating. If a facility smells like feces and urine, looks dirty or the linens feel as though they haven’t been changed lately, trust your instinct to move on to a different facility.
