On July 26, 2006, our firm successfully concluded a case which involved both a medication error and medical malpractice. The settlement amount was confidential. The patient -- Jane Doe had a stroke in September of 2001 and was placed on a blood thinner medication known as Coumadin to prevent further strokes. She was a smoker and also had a history of atrial fibrillation, which resulted in an increased risk of blood clots to the brain.

During her treatment for this nondisabling stroke it was discovered that she had an abnormal clotting factor in her blood which also increased her riskof a stroke or cerebral vascular accident.
She did well until Febuary 15th 2005 when her doctor took her off of the Coumadin -- a medication error. Her daughter thought that her mother had misunderstood the doctor and personally confirmed with the doctor's office and was again advised that her mom was to stop the Coumadin.

On April 29, 2005 Jane Doe sustained a massive stroke to the brain stem. She survived but cannot walk, talk, feed herself or even swallow. She is bedridden and requires 24 hour care. The case was settled for a confidential amount with a combination of lifetime monthly payments and cash.

Medication errors cause a large number of injuries to patients each year and many are preventable.

Jane Higdon was killed on May 31, 2006 while riding her bicycle on Territorial Highway. The section of Territorial where Jane was killed has at least five wineries or tasting rooms close by and is a popular route for tourists and locals alike. It is a vivid example of how cyclists on our roadways in Oregon can be placed in an area of danger.

Cyclists and drivers need to follow the rules of the road to prevent cyclists from being hurt or killed on the road.

Floyd Prozanski a state senator and avid cyclist who rode with Jane Higdon in a twice-weekly riding group for more than six years wrote an editorial for the Eugene-Register Guard discussing what can be done in our state.

"First, everyone needs to remember and follow the basic rules of the road already in place. Under Oregon's law, bicycles are defined as vehicles and are entitled to use the roadways just like any other vehicle. The Oregon Driver Manual warns drivers: "Do not crowd bicyclists. Wait for a clear stretch of road before passing a bicyclist who is moving slower than your motor vehicle in a lane too narrow to share. Remember, the bicycle is a slow-moving vehicle and this may require you to slow down. The greater the speed difference between you and a bicyclist, the more room you should allow when passing."

Jane Paulson received a verdict for $600,000 last month in a claim against Willamette Dental for a lingual nerve injury.

Our client's lingual nerve was damaged during the extraction of his wisdom tooth leaving him with numbness and pain, tingling, burning pain, shooting pain and throbbing pain in this tongue, difficulty with biting and use of his tongue, decreased taste sensation, numb gums on the right side of his mouth, difficulty speaking, and the inability to distinguish hot from cold.

The defense offered to settle for $50,000 before trial and maybe could come up to $75,000 during trial.

Many patients are told a serious, permanent lingual nerve injury is simply a risk of the procedure. We educate the jury that a serious, permanent lingual nerve injury is usually due to doctor error. The lingual nerve injury verdict is Jane Paulson's fourth involving negligent removal of wisdom teeth.
