This summer, Jane Paulson won a $600,000 lingual nerve injury verdict. Our client's lingual nerve was injured during a routine wisdom tooth extraction. Opening statements were given yesterday in the first medical malpractice trial against OHSU in Oregon since last month when the Oregon Court of Appeals overruled the cap in another malpractice case.

The plaintiff is Ken Ackerman, a former Portland TV anchorman, who is suing Oregon Health & Science University for medical malpractice from a back surgery.

The tort claim cap, in Oregon, against valid public entities is $100,000 economic damages and $100,000 non-economic damages. Many people believe OHSU is no longer entitled to protection of the cap since it only receives 3% public money and, in many ways, acts as a private corporation.

The trial is a medical malpractice trial being held in Judge Michael Marcus' courtroom in Multnomah County, Oregon.

The drunk driver, who killed an innocent young man and seriously injured his brother, pled guilty in the Clackamas County Courthouse on Tuesday August 8, 2006. The drunk driver caused an automobile accident in Lake Oswego, Oregon on December 21, 2004. The drunk driver was from Lake Oswego, Oregon and was sentenced to 60 months in jail under a plea agreement. The parents of the boys hope the drunk driver sees this as an opportunity to change her life and to help educate others and prevent the needless death or injury of others by drunk or impaired drivers. A drunk driver killed an innocent young man and seriously injured his brother over a year and a half ago. The drunk driver, who had a blood alcohol level over two times the legal limit in Oregon, is scheduled to plead guilty to the crimes August 8, 2006. It will be one step forward for the victims' family.

Drunk drivers needlessly cause serious injuries and wrongful death in Oregon. It is illegal to drive in Oregon with a blood alcohol content greater than .08. Many individuals lose judgment when they drink and get behind the wheel.
