Personal injury lawyers are the folks you need to get in touch with if you think you may be eligible to file a personal injury claim. There are many things that need to happen before damages can be collected and this area of law is where personal injury lawyers have their expertise.

You will need to have at least a minimal understanding of personal injury law and that's where personal injury lawyers come in. Your attorney will help you determine if you have a case and be able to answer any questions you may have.

Personal injury lawyers will tell you that if you can show that someone bears legal responsibility for your personal injury and that the damage you are claiming really reflects the extent of your loss or injury, you may have a personal injury case that can be pursued. There is not a personal injury case that does not address two important factors called damages and liability.

You will find that personal injury lawyers will help you establish your case based on these three elements: intentional wrong, negligence and strict liability.

Sometimes you can claim intentional wrong and pursue a civil personal injury lawsuit in addition to filing criminal charges. Discuss these issues with a personal injury lawyer and see if you have a case.

When personal injury lawyers file a personal injury case as a tort of negligence it means you are accusing the defendant of causing your injury by not preventing it.

Personal injury lawyers will also be able to assist you if you have a strict liability case. These are cases that apply whether or not malice or negligence is involved.

Contact personal injury lawyers if you think you have a personal injury case.

Before you start calling all the personal injury lawyers in the yellow pages you may want some information about personal injury laws and claims.

Protection is the main goal of personal injury law. Protection from the recklessness, negligence, inaction or malpractice of others. You may also hear personal injury law referred to as tort law. This area of law includes many different legal claims including auto accidents, defective drugs, wrongful death, medical malpractice, worker's compensation and product liability.

Under the personal injury laws each victim can file a claim for emotional damages, physical injury and sometimes even for property damages. Personal injury lawyers understand all these areas and can help you if you have a viable claim. In some cases personal injury lawyers will be able to help family members with a personal injury lawsuit of an injured or deceased loved one who can not file on their own.

Personal injury lawyers may be needed if your claim is a substantial one. While you may be able to sort out a simple fender bender situation you would not want to be without a personal injury lawyer if you have a wrongful death claim.

Look for personal injury lawyers who have good reputations and seem willing to spend the time necessary on your case. Since you may be eligible to receive damages, personal injury lawyers with experience may be the best way to go.

In part 2 of this series you will gain insight into understanding personal injury law and how personal injury lawyers can assist you in establishing your claim.

The best thing to do if you are in a situation where you suspect medical negligence is to consult a medical malpractice lawyer.

There are many times when a medical malpractice lawyer is crucial. You will not be able to handle a medical malpractice suit by yourself, unless you are an attorney.

Injury can occur during surgery. One type of medical malpractice suit involves the use of anesthesia. When anesthesia is not given in a timely manner or is administered improperly, injury or death can occur. A medical malpractice lawyer can help you if you are involved in such a situation.

There are times that medical negligence occurs in the OB-GYN field. A medical malpractice lawyer may be helpful if you think you have been misdiagnosed with a gynecological disease like cervical, breast or ovarian cancer. Endometriosis and pelvic inflammatory disease as well as other diseases may cause fertility or pregnancy complications. When these medical situations are misdiagnosed, serious complications can occur.

Medical negligence sometimes occurs during birth and delivery. When a pregnant woman is not treated properly, birth defects or injuries sometimes take place. A medical malpractice lawyer can help you during this difficult time.

Every state has different laws that apply to medical malpractice negligence. There are also time limits for filing a medical malpractice suit. Contact a medical malpractice lawyer for information about the laws and filing considerations in your state.

Choosing the right medical malpractice lawyer is important. You may want to do some research before you choose your attorney. You can look at references and meet with a few attorneys before you make your choice. Choose a medical malpractice lawyer who has a good reputations and one who you feel comfortable with.

Many patient rights advocates are praising a judge's recent refusal to seal a medical malpractice settlement and are encouraging others to take the same stance. The judge's decision in the case bucked the common practice within the legal community of allowing settlements of lawsuits to be filed confidentially. "In medical cases, the practice puts the public at risk by shielding sub-par physicians from public disclosure of their mistakes," said Paul Lyon, spokesman for The Committee For Justice For All, a non-profit group that advocates for plaintiffs' rights in civil litigation.

Defendants often request medical malpractice settlements be confidential and often make settlement contingent on it. Read more about the drawbacks to making medical malpractice settlements confidential.

Before you can determine if you need a medical malpractice lawyer you need to know a little about medical malpractice.

Medical malpractice is negligence committed by a health care provider. This includes doctors, dentists, nurses, technicians, a hospital or a hospital worker. You may need a medical malpractice lawyer if you have experienced a deviance of performance from a standard of practice of those with similar training that resulted in harm to you or a family member.

Often a medical malpractice lawyer is hired on cases of medical negligence. This negligence occurs when a patient is harmed because a medical care professional did not meet the required standards of medical care.

The prescribed standard of care can vary depending on the state in which the negligence occurred. A medical malpractice lawyer can help you decide if you have a case.

Sometimes a person may feel they have a case because treatment was not successful. This is not always a reason for a medical malpractice suit but a medical malpractice lawyer can tell you whether your case is worth pursuing.

Check with a medical malpractice lawyer if you have been injured because of a misdiagnosis when routine procedures and tests were not followed. Another instance when you may need the services of a medical malpractice lawyer is if a drug that was prescribed was illegal or not approved for your condition.

If you think you may have a medical malpractice situation, the best thing to do is to consult a medical malpractice lawyer.

An interesting editorial in the NY Times on September 9, 2006 discusses a study done about doctors who have made medical errors, or committed medical malpractice, and whether the doctors inform their patients.

"It's probably no surprise that doctors are less likely to admit a serious mistake if they think they can get away with it than if they think the patient will find out. But now we have confirmation from a survey of some 2,600 doctors in the United States and Canada concerning what they would tell patients about serious medical errors in four hypothetical cases. "

Today in Portland, Oregon, a jury returned a $1.4 million dollar medical malpractice verdict against Oregon Health Sciences for injury to Ken Ackerman. The case is the first medical malpractice verdict in Oregon against OHSU after the Court of Appeals ruled that individual doctors can be sued for more than the tort claims limit ($100,000 non-economic damages and $100,000 economic damages).

Personal injury lawyers can represent people who have suffered from brain injuries. Here are some questions and answers that may help you if you are in need of a personal injury lawyer because of a brain injury:

What is a traumatic brain injury? This is the impairment of normal brain function that occurs in an open or closed head injury.

What are the general symptoms of a brain injury? The symptoms can vary quite a bit because of the many functions of the brain. There are however four general categories of symptoms and your personal injury lawyer can explain each one to you.

What are the perceptual symptoms of a brain injury? You may experience changes in hearing, vision or sense of touch as well as having a loss of the sense of space and time. Other symptoms include loss of balance, changes in taste and smell or increased sensitivity to pain.

What are the behavioral/emotional symptoms of a brain injury? Apathy, flattened or heightened emotional responses and irritability may occur as well as inflexibility, impatience or lack of inhibition. Discuss these symptoms with your personal injury lawyer.

What are the cognitive symptoms that can indicate a brain injury? The cognitive functioning of the brain may be impaired in one or more of these ways: inability to understand abstract concepts, language deficits, shortened attention span or memory loss. Personal injury lawyers will be able to discuss these cognitive symptoms and others.

What are the physical symptoms of a brain injury? A few include seizure activity, paralysis, headaches, sleep disorders and extreme physical or mental fatigue.

All of these questions and more can be discussed and answered with the help of personal injury lawyers.
